Judge Bunning (appropriately) releases Kim Davis from custody, because her Deputies are issuing marriage licenses

Marty Lederman

As I suggested ought to happen, Judge Bunning has ordered that Kim Davis be released from federal custody, in light of the fact that her Deputies are now issuing marriage licenses -- licenses that the judge assumes are valid without Davis's name, since plaintiffs have not suggested otherwise.  The judge further orders that Davis "shall not interfere in any way, directly or indirectly, with the efforts of her deputy clerks to issue marriage licenses to all legally eligible couples," and warns that "[i]f Defendant Davis should interfere in any way with their issuance, that will be considered a violation of this Order and appropriate sanctions will be considered."
