Castro v. Trump

Gerard N. Magliocca

Today the Supreme Court denied certiorari in Castro v. Trump, which raised a Section Three challenge. A lower federal court held that Castro lacked standing to challenge Trump's ballot eligibility in Florida. The denial of certiorari was not surprising.

The interesting point about Castro is that no recusals were noted from consideration of the petition. This probably means that all nine Justices will participate when a suitable Section Three challenge reaches the Court and certiorari is granted.
