Stop Whistling Past the Graveyard

Gerard N. Magliocca

Let's take stock for a moment. The leading presidential candidate for the Republican presidential nomination will soon, as LeBron James might say, be under not one, not two, not three, but four criminal indictments. At least one of these trials will occur next year.

We are heading for a constitutional crisis. Can fair criminal trials be conducted against a candidate in the middle of a presidential campaign? What happens if Trump is convicted after he is nominated? What if he's convicted in federal court and wins the election? What if he's convicted in state court and wins? The list goes on and on.

There is a way out of this mess. I've made the point repeatedly since January 6th, 2021: Donald Trump is ineligible to serve as President under Section Three of the Fourteenth Amendment and should be excluded from the ballot. One group that will be litigating those cases released a 90-page report today summarizing the case. More is on the way.
