Bostock, LGBT Discrimination, and the Subtractive Moves

My sustained defense of Bostock v. Clayton County is now published, in Minnesota Law Review Headnotes, here.  In Bostock, the Supreme Court held that Title VII of the Civil Rights Act of 1964, which prohibits sex discrimination in employment, bars discrimination on the basis of sexual orientation and gender identity.  The article catalogues and refutes efforts to subtract LGBT people from the statute's coverage.
