The Court's "Notice and Comment" Order in Zubik

Marty is the resident expert on this case, but I want to point out that the Supreme Court's request for supplemental issued yesterday is very strange.  The order reads more like a proposed rule of an administrative agency, both in its specificity and in the way that it gives interested parties (though in this instance only the parties of record) time to offer their thoughts before a final decision is taken.

I don't see why this case is different from any other where the Court ends up using a legal theory that was not briefed or argued.  In every decision of that sort, should the parties be given an opportunity to file supplemental briefs commenting on the idea before the opinion issues? Maybe that procedure will lead to better decisions, but if so it should be used consistently from now on.

Comments:

Was this request unanimously issued? Can a majority - or less than a majority - of the Court make such a request? If unanimous, this might suggest that the collective 8 Justices may be sending a message to the Senate Republicans that they should get off their duffs on Pres. Obama's Court nominee.
 

I gather such a request in the name of the Court (a single judge can ask for briefing only in respect to their circuit duties) requires a majority.

The one here did not have a public dissent but I have been warned that this doesn't mean no justice dissented. They just didn't publicly do so. A distinction that doesn't really impress, but such is the understanding usually given.

The general tea leaves talk is that people assume Justice Kennedy is trying to decide, the other seven deemed set in their ways. OTOH, one of the others might be trying to find a solution to avoid a third equally divided ruling. They might want a full bench, but it's less a message than a desire not to look unable to decide.

Anyway, I also find the order curious but it is understandable if the Court wants to do something special to settle a tricky decision that otherwise will go down 4-4. Maybe that doesn't matter especially the level of micromanaging suggested by the order -- they should simply re-hear it, hoping for a full bench.
 

Keep in mind CJ Roberts' pre-emptive statement (as to the Garland nomination) concerning the Senate's consideration of judicial appointees. He surely is aware that the Court's approval ratings had been dipping before Judge Garland's nomination. If a majority is required, as Joe suggests, for the request, was the 5th vote from the conservative or liberal side? I'm sure that the Court wants to increase its approvals, especially in a presidential election year. I assume that CJ Roberts is sincere in his position that the Court is not political. But might this request result in a delay such that the cases won't be decided before the November elections?

I deleted a comment I posted earlier this afternoon after testing in order to determine glitches for the thread. I think upon reflection that someone took steps intending to delete spam (no, not SPAM I AM!, but deleted everything after such spam. Only at the beginning were comments by me, Joe, and me again retained followed by spam that was retained. I don't know if there can be a restoration of non-spam comments that were deleted. While many were off topic, therewere some interesting issues discussed, including of a political nature. some with tongue in cheek. Or were we hacked by the Cruz Canadacy in conspiracy with Kasich. Sound the trumpets!

Query: If Trump loses the general election (or the GOP nomination), might he make lemonade at his hotels with "UNPRESIDENTIAL" Suites?
 

If not lemonade then perhaps orangeade?
