Sorry I've been slow in getting around to the posts about the Yoo torture-and-maiming memo. I'll try to begin catching up over the next few days.

In the meantime, over at Convictions last Friday through Monday, I was engaged in a couple of colloquies about the Yoo memo -- and what the CIA should be permitted to do going forward -- with Eric Posner and Ben Wittes. I wonder if Eric Posner, indeed, anyone who generally shares his views, have read Daniel Ellsberg's Secrets: A Memoir of Vietnam and the Pentagon Papers (2002). If they have, they can only be charitably described as having succumbed to egregious self-deception and related states of denial. It's further evidence that the "best and brightest" are frequently prone to ethical occlusion, historical myopia and cognitive biases, shortcomings with grave consequences for the rest of us when they are in the service of the executive branch.

Do take note of the new issue of the Michigan Law Review in which Yoo reviews All Quiet on the Western Front. Surprise, he's against collective security.
