Understanding the OLC Torture Memos (Part II)

Despite the notable and significant improvements of the new Levin OLC Opinion on the federal torture statute that I discuss in the previous post, Professor Dorf is also right to focus upon lingering, serious concerns about two things that are conspicuously absent from the new OLC memo.

Three minor points regarding your extended commentary. One: OLC practice is not to publish every opinion it issues. Those opinions are screened and those that touch upon classified subject matter are routinely NOT published. There was nothing out of the ordinary about that aspect of the opinions. Two: Published reports indicates a second OLC memorandum on specific CIA practices has still not been released or leaked. The leaked memorandum lacks a great deal of concrete context. I think that we ought to want to see that memorandum before passing judgment on the remaining parts. I do not read as broadly some parts of the memorandum as you or others in the press do, having turned to the CAT myself to gain additional understanding. I think that certain parts of the opinion may have been poorly written because of time pressure (capture of Zubaydah) not because of a desire to place the President above the law. Three: What I would agree on, particularly with respect to my first comment, is that those currently within the Admnistration have not painted the whole picture in a way that, at this point, is somewhat frustrating. Four: Much of the press, and commentary reflexively feeding off that press, has mixed a memo about Zubaydah and that limited intended application with its subsequent mis-use without authorization by the head of OLC by those of the Defense Department in March 2003. I would be speculating about who is to blame for that, but the inference I draw is that John Yoo should be horse whipped for not having read the book, "How I behave as a subordinate government official in the Office of an Executive Branch Department," before entering government service. (Obviously, there is no such book; Yoo apparently did not understand his role at times and how -- as the memos show -- not paying close attention to the institutional reasons behind fulfilling a role could lead to unforeseen legal problems that an experienced government attorney would understand.

When you skip a payment, the loan continues to accrue interest; therefore, these offers simply increase the overall interest and finance charges that the creditor collects. On a similar note, beware of offers of no payment/no interest for a period of time. Furniture stores, jewelry stores, and electronics stores frequently offer these programs. For example, no payment/no interest for 12 months!! This can be a good offer, but once again, read the fine print. Make sure you know the details of the program. Generally, you need to pay off the entire balance before the end of the "free" period to receive the benefit. Otherwise, you will probably have to pay interest on the entire balance from the date of your purchase
