Supreme Court of Canada Invalidates Prime Minister's Appointment of new Justice to The Supreme Court of Canada

Rick Pildes

Yes, you read that headline correctly.  This is one of the more remarkable decisions from a country's highest court I have seen in some time.  The Court held that the new Justice was not legally qualified for the job.  Here is an excerpt from a news story describing today's development:

The court ruled 6-1 that the purpose of the special appointment rules for Quebec judges is “to ensure civil law expertise and the representation of Quebec’s legal traditions and social values on the Court, and to enhance the confidence of Quebec in the Court.” Justice Michael Moldaver of Ontario dissented.
