Consequences of Invalidating the ACA

Here's an oped I wrote in yesterday's Philadelphia Inquirer on the consequences of invalidating some or all of the Affordable Care Act. The piece draws from the theory of collective action federalism that I have developed with Robert Cooter. Today's National Law Journal discusses the theory here.

The oped has earned me more than the usual amount of hostile e-mail. Most fascinating are the multiple accusations that I probably sided with the accuser in the Duke Lacrosse case.
